All Perspective is Gone

I found this post on Kevin, MD. How sad that it is titled "Tort Reform is Working." A state that hasn't disciplined a guy who has settled or lost 40 malpractice actions in a couple of years now makes it even harder to hold him accountable.

And the amazing thing is that the only evidence that tort reform is "working" is that insurers are making more money. Which, in the end, is what this is all about. And doctors hoping to save a few dollars on their insurance premiums.

I wonder when the new study will come out showing how much less "defensive medicine" is being practiced. Or will that claim just disappear until the next economic downturn when the insurers aren't making as much and come back for more "reform"? Who wants to bet on that? Anyone?

And doctors call lawyers greedy. . .

Matt,
I have a question. Is it true that malpractice insurers send letters to physicians stating that if they are honest with a patient and aplogize following a medical error that they may not back them on a claim? Yet, they can back a doc who has had several claims against him, such as this one? I don't get it.

Secondly, has anyone ever sued an insurance company for lack of ethics and cruel and inhumane treatment of patients, as well as docs who want to be accountable? They seem to be using black mail tactics for monetary gain.

When will an era of compassion replace this era of corruption that we seem to be in the midst of?

As I've said before, I have done little medical malpractice work (I think I once said my firm doesn't do any, and that's not true), but I'm not expert on it. So I really couldn't tell you what insurers are telling their physicians. You should ask some of the docs on their blogs.

I wouldn't make this stuff up, and if I ever do cite faulty statistics, I expect to be called out on it. I do not believe in making stuff up to support one's claims, and I do not want to be repeating false info.

I've gotten paranoid about even going to doctors. Last Friday, just as I was going under for an endoscopy, I blurted to the doctor, "I'm not pro-plaintiff. Honest."

Although each claim is on its own merit, some people as we all know make a living out of malpractice suits (patients I mean), some doctors are arrogant to a point that they deserve a suit others are just subject to an unfortunate state of events and should not really be held accountable, patients put their lives and trust in doctors and for the most part the doctor his held liable for treatment and on occasion for withholding or failure to provide treatment, some blame must lie with patient in these cases and this should be taken into account.
